What is Cannabinol (CBD)?

 CBD stands for cannabidiol and is an active ingredient of the plant cannabis Sativa (hemp). Is CBD Legal in West Virginia?

Yes, CBD sourced from hemp and its products are legal in West Virginia. Hemp was legislated in 2002 with the passage of SB 447. This bill found that industrial hemp development and usage could improve the state’s economy and agricultural vitality. In 2018, the state passed the West Virginia Hemp Development Act. In this act, hemp with no more than .3% THC is considered an agricultural commodity.

Furthermore, West Virginia is among the many states who have embraced the 2018 Farm Bill, which stated that the federal government would treat industrial hemp as an agricultural commodity rather than a controlled substance. However, it is essential to note that federal and state barriers to the growth and sale of hemp products still exist.  In 2019, West Virginia’s state licensing program for hemp was modified to better match the federal government’s legalization of the product and helped to ensure that CBD would stay legal in the state.

What Type of CBD is Sometimes Not Legal?

There are two different types of CBD — one extracted from the hemp variety and one derived from the marijuana variety. The CBD that is extracted from the hemp variety is legal to buy and use across the state of West Virginia, as long as you are over the age of 18. The other type of CBD, extracted from the marijuana variety, is legal for only medical use in West Virginia. In 2017, SB 386 allowed marijuana to be used for certified medical use by West Virginia residents with severe medical conditions. Recreational usage of marijuana-derived CBD remains illegal here in the state. It can result in a misdemeanor with an incarceration time ranging from 90 days to 6 months and a fine of up to $1,000.

Most CBD producers typically include the following information on product labels:

  • Amount of active CBD per serving
  • Supplement Fact panel, including other ingredients
  • Net weight
  • Manufacturer or distributor name
  • Suggested use
  • Full-spectrum, broad-spectrum, or isolate
  • Batch or date code

We produce a wide variety of hemp-derived CBD products for people and their four-legged friends. The endocannabinoid system is our body’s internal system, which maintains homeostasis, allowing body mechanisms to function in a normal state. We share this feature with animals. The base cannabidiol is extracted utilizing subcritical CO2 extraction, which is Generally Regarded As Safe (GRAS) by the FDA. CO2 extraction uses liquid CO2 under moderate-to-high pressure and low temperatures to solubilize or sequester the cannabidiol from the hemp plant. Upon arrival at the extraction facility (Canna-Ventures of WV), the biomass undergoes extensive testing for herbicides, pesticides, heavy metals, and toxicological contamination. Once the biomass is cleared, the extraction process begins.

Upon the transformation to cannabinol, our company tests again for a wide range of contaminants and total cannabinoid content. Once it is cleared for use, retail products are manufactured in an FDA-approved facility according to GMP standards by a board-certified toxicologist who oversees other staff formulation and the chemist responsible for product manufacturing and development.
